The Appeal Court sitting in Kaduna has nullified the election of Spokesman of the Senate, Senator Dayo Adeyeye, and declared the People’s Democratic Party (PDP) Senator Biodun Olujinmi as the winner of the Ekiti South Senatorial election held on February 23.
The Appellate Court sitting in Kaduna on Wednesday upheld the tribunal judgement sacking Dayo Adeyeye of the All Progressive Congress (APC) and declared the PDP’s candidate, Senator Biodun Olujimi the winner.
The Independent National Electoral Commission (INEC) had, in February 2019, declared Dayo Adeyeye as the winner of the Ekiti South Senatorial election, but Mrs Olujimi who challenged the result of the election approached the court on the basis that she scored the highest number of votes cast.
Senator Olujimi in her petition claimed that the election was marred with massive irregularities and that it was not conducted in compliance with the provisions of the Electoral Acts.
The Tribunal in its judgement nullified elections in some polling units and declared Senator Olujinmi as the authentic winner of the poll.
Adeyeye, who was dissatisfied with Tribunal’s judgement filed a petition at the court of appeal asking it to set aside the tribunal ruling.
Meanwhile, the Appeal Court in a unanimous judgement led by Justice Uzor Anywu on Wednesday upheld the judgement of the Tribunal and ordered INEC to issue a certificate of return to Senator Biodun Olujimi of PDP.
