Court admits driver to N500,000 bail for Alleged reckless driving

On Thursday, a Chief Magistrates’ Court in Kogi granted a motorist, Ismail Mamudu, N500,000 bail for alleged unsafe and reckless driving.

Mamudu was charged with dangerous and reckless driving.

He entered a not guilty plea to the charge.

Chief Magistrate Mohammed Tanko ordered the defendant to produce one surety, who must be a Lokoja resident.

Tanko postponed the case until January 6 for a hearing.

Earlier, the Prosecution Counsel, Ubana Ubi, told the Court that on June 9, the defendant drove dangerously and recklessly, colliding with and damaging another vehicle with the registration number of Bassa Local Government Area of Plateau along Antakpe Junction in Lokoja.

He stated that the offense is punishable under sections 81 and 85 of the FRSC Act 2007 and the Federal Highway Act, respectively.

M.F. Sanni, the defense counsel, had previously pleaded for bail in the most lenient terms for his client.

Sanni did not object to the adjournment request.

“We do not oppose the application for adjournment, but we would like to move an application for bail in accordance with Sections 36(5) of the FRN 2008 Constitution and 156 of the Kogi Penal Code Law, pending his trial.”

“In addition, the defendant has pledged to make himself available during the course of his trial.” “We humbly request that this application be granted,” Sanni pleaded.

The prosecutor did not object to the bail application, instead saying, “My Lord, we leave that to the discretion of the Court.”
