The Police in Osun, on Wednesday, arraigned two persons before an Osogbo Chief Magistrates ‘ Court, over alleged assault and breach of public peace.
The defendants, Bright Iyegbe , 46, and Fasanmi Afolabi , 53, whose house addresses were not given, are being tried on charges bothering on assault and breach of public peace.
The Police Prosecutor, Insp Kayode Adeoye , told the court that the defendants committed the offence on Aug. 31, at about 10:00 a.m., at Dada Estate , Osogbo.
Adeoye alleged that the defendants constituted public nuisance when they engaged in street scuffle before the intervention of policemen .
He told the court that the scenario almost led to the breach of public peace within the vicinity where the incident occurred .
The prosecutor said the offence contravened sections 249 (d) and 86 of the criminal code cap 33 , vol. 11 , laws of Osun, 2002 .
The defendants pleaded not guilty to the charges.
The defence Counsel, Mr Theophilus Idowu, prayed the court to grant his clients bail in the most liberal terms.
The Chief Magistrate, Mr A.A Adeyeba , granted the defendants bail in the sum of N100, 000 each and one surety in the like sum.
Adeyeba said the surety must reside within the jurisdiction of the court, and should show evidence of tax payments to the court’s registrar as part of the bail conditions.
He adjourned the case until Nov.4 for mention
