A Federal High Court in Damaturu, Yobe State capital, has granted an application for an order of substituted service of court processes on the Senate President, Ahmad Lawan.
The application was filed by the winner of Yobe North All Progressives Congress (APC) senatorial primary election, Hon. Bashir Sheriff Machina.
The presiding judge, Justice Fadimatu Mohammed, granted the application after one of the lead counsels to Machina, Nureini Jimoh (SAN), moved the application that since the case was filed in the court on 22nd June 2022, the bailiffs found it difficult to serve the writ of summons to the Senate President who is the second defendant in the case.
Bashir Machina had, in a suit filed on the 22nd of June 2022, asked the Federal High Court sitting in Damaturu to declare him the authentic senatorial candidate of the APC for Yobe North and order the Independent National Electoral Commission (INEC) to recognize him as such.
The case was adjourned to 15th August 2022 to ensure that the parties have been properly served.
Recall that, Bashir Shariff Machina has been in a tussle with Lawan over the Yobe North Senatorial ticket.
