A group loyal to former minister of state for education Chukwuemeka Nwajiuba filed a lawsuit in Abuja’s Court of Appeal, seeking to have Asiwaju Bola Tinubu’s nomination for president of the All Progressives Congress overturned (APC).
In a ruling issued on February 17 by a three-person court panel, it was determined that the appeal filed by the Incorporated Trustees of Rights for All International (ITRAI) was inadmissible.
It upheld the APC’s argument that the appellant’s suit, which was filed at the Federal High Court of Abuja, was not a pre-election matter because the appellant was an NGO and not a person who fell under the provisions of Section 285(14)a, b, or c of the 1999 Constitution.
The appellate court held that the removal of the Nwajiuba who was a party in the case at the lower court meant the judgment of the lower court was not appealed.
The court proceeded to strike out the price of appeal filed by the appellant. On the merit, the court dismissed the entire appeal for lacking in merit.
The court noted that the appeal was an attempt by the appellant – the Incorporated trustees of Rights for All International – to revive itself having earlier been dissolved by the judgment of the trial court.
