The Presidential Election Petition Court, PEPC, sitting at the Court of Appeal in Abuja on Wednesday, ordered the Independent National Electoral Commission, INEC, to provide the President-elect, Bola Tinubu, access to sensitive materials used in the presidential election.
A three-member panel of the court, presided over by Judge Joseph Ikyegh, reached a unanimity in its ruling, concluding that Tinubu’s plea for access to the election records so he could defend his victory had validity.
It was determined that Tinubu and his party, the All Progressives Congress, both had a right to access the materials kept by INEC so that they may examine, scan, and make copies of them.
Both Tinubu and the APC had in separate exparte applications they brought before the court, said they would need the materials to prepare their defence against petitions that would seek to nullify the outcome of the election.
“The materials will be relevant in helping us to prepare our defence and also make comparison with information contained in INEC’s back-end server”, Tinubu’s lawyer, Mr. Akintola Makinde submitted.
