Dr. Iyorchia Ayu, the ex-national Chairman of the Peoples Democratic Party (PDP), has withdrawn his appeal suit against the PDP and Conrad Utaan, according to documents filed on April 15, 2024.
The withdrawal notice, found in Appeal No: CA/MK/88/2024 before the Makurdi Court of Appeal, cites the appellant’s intention to retract the appeal filed on June 27, 2023 fully.
Previously, a high court in Gboko, Benue, dismissed a suit on September 1, 2023, seeking to overturn Ayu’s suspension from the PDP. Initiated by Nongo Ordue on behalf of Ayu’s council ward, the suit aimed to reinstate Ayu as PDP’s National Chairman.
However, Clement Mue, representing the PDP, argued that a prior judgment, MHC/85/2023, sufficiently addressed the issues raised. Mue noted Ayu’s appeal against the decision, cautioning against revisiting the matter.
Justice D.M Igyuse observed a similar claim filed by the plaintiffs, describing the current suit as an abuse of the court process. Consequently, the court dismissed the suit, upholding Mue’s argument.
